1. Who these terms are for
These terms apply to practitioners and studios that publish services, classes, events or products on Maarwell. They add to the Terms of Service.
You accept these terms when you publish your profile. We keep the version you accepted and the date.
2. Your service and your clients
The contract for each session, class or event is between you and the client. You set prices, times and policies, receive payments directly and issue the receipts or invoices the law requires.
You must hold any registration, licence or insurance the law requires for what you offer, and offer your own Livro de Reclamações (complaints book).
You offer your services as a professional (a business or self-employed person), not as a private individual, and tell us if that changes. Clients see this on your profile and when they book.
3. Restriction, suspension and termination
We may restrict or suspend a profile, or part of it, for breach of these terms or the Terms of Service, illegal content, fraud, a risk to clients' safety, or repeated well-founded complaints.
When we do, we email you, at the moment the decision takes effect, the specific reasons and the rule applied, and how you can contest it.
To close your account on our initiative, we give at least 30 days' notice with the reasons, unless the law or a serious safety risk requires immediate closure.
4. Changes to these terms
We email you at least 15 days before any change takes effect. If you don't agree, you can close your account before that date.
5. How results are ordered
Results are ordered by a quality score: rating (adjusted for how many reviews there are), availability, a complete profile (photo, bio, a bookable service and verification) and how well the profile matches the search. Profiles that accept booking requests come before profiles that don't.
Exact ties are settled by verification, then featured placement, then name. Featured placement is earned through activity on the platform and is never sold. No one can pay for a higher position.
6. Differentiated treatment
Paid plans (Pro and Studio) unlock tools, not a position in results. Any profiles run by the Maarwell team follow the same ordering rules.
7. Access to data
You can access the data you provide and the data your activity creates: clients, bookings, recorded payments, reviews and messages. You can export it from your workspace.
Maarwell uses this data to run the platform and does not share it with other practitioners or studios.
8. Complaints
You can complain about any decision of ours that affects you (for example a suspension or how your profile appears) by replying to the decision email or writing to the contact below. We review every complaint and answer in writing.
Maarwell is a small enterprise, so Regulation (EU) 2019/1150 does not require it to name mediators (Art. 12(7)). If a complaint is not resolved, you can go to the courts or, if we both agree, to mediation.
9. Processing your clients' data
For the data you collect about your clients (for example session notes and intake forms), you are the controller and Maarwell processes it on your behalf, as processor, only to provide the service.
- We process the data only on your instructions, which are the features you use on the platform.
- People at Maarwell who access the data are bound by confidentiality.
- We use appropriate security measures and sub-processors with equivalent guarantees: Supabase (database, EU), Vercel (hosting), Resend (email), Stripe (subscriptions) and Google (calendar sync, if you connect it).
- Before you record information about a client's health (for example injuries, pregnancy or medication), get their explicit consent (GDPR Art. 9(2)(a)) and keep a record of it. You are responsible for the legal basis for that data.
- We help you answer data-subject requests and notify you without undue delay of any data breach that affects them.
- When the relationship ends, we delete or return the data unless the law requires us to keep it.
10. Governing law
These terms are governed by Portuguese law, with the Portuguese courts as forum, without prejudice to mandatory rules.
