1. About these terms
These terms apply when you create an account, book a session, class or event, buy a pass, gift or product, publish a profile, or otherwise use Maarwell. By doing so you accept them. Please also read the Privacy Policy.
Maarwell is based in Portugal.
These terms are published in Portuguese and English. Both versions are equally valid; if they differ, the meaning more favourable to the consumer applies.
Practitioners and studios also accept the Practitioner Terms.
2. Maarwell's role
Maarwell is an online wellness marketplace and practice-management tool. We help clients find practitioners and studios, book and pay them directly, and manage sessions, classes, events, passes, messages and reviews.
When you book a session, class or event, buy a pass or order from a studio shop, the contract is between you and that practitioner or studio. Maarwell is not a party to it, does not provide the service, and is not an employer, agent, clinic, or medical, psychological, nutrition or emergency service.
Practitioners and studios on Maarwell offer their services as independent professionals, so EU consumer law protects your contract with them.
3. Accounts and eligibility
You must be 18 or older to create an account, book a session or register for a class. We ask you to confirm this when you sign up and on every booking made without an account.
Give accurate information, keep your sign-in details secure and use one account per person. You are responsible for what happens in your account; tell us at once if you think someone else is using it.
4. Booking a session, class or event
What happens when you book depends on the practitioner's settings and how you pay:
- Confirmed at once: when you use a pass, when nothing is owed, or when you pay in person.
- Held for you: when you pay by bank transfer, MB WAY or payment link, your place is held while you pay. The booking shows the deadline: usually 24 hours, and never later than 12 hours before the session; for sessions in the next 24 hours, 2 hours or until the start. If the practitioner hasn't recorded payment by then, the hold is released.
- If you tap "I've paid", your place is not released at the deadline: the practitioner checks the payment and confirms it.
- Request: if the practitioner reviews new clients first, or for a recurring series, the booking is a request until they accept. Requests not answered within 48 hours (or by the session start, if sooner) expire.
- To prevent abuse, a guest (booking without an account) can hold at most 3 unpaid places at a time, and we may limit repeated attempts.
A booking is confirmed only when it shows as confirmed. Check the time, place, price and the practitioner's policies before you book: they are part of your contract with the practitioner.
5. Cancelling, changes and refunds
You can withdraw a request, or a hold you haven't paid, at any time before it starts.
You can cancel a confirmed or paid booking yourself up to the practitioner's notice period (24 hours unless the profile says otherwise). Inside that period you can ask the practitioner to cancel; they decide under their policy.
Refunds follow the cancellation policy shown when you booked: Flexible (full refund up to 24 hours before), Moderate (up to 48 hours before) or Strict/custom, as described. If the practitioner or studio cancels, or a hold is released after you paid, you are owed everything you paid.
Refunds are paid by the practitioner or studio, who received your money. Maarwell does not hold your payment and cannot refund it, but you can contact us if a practitioner does not respond.
None of this limits your legal rights, for example if a service is not provided as agreed.
6. Payments
Maarwell supports direct practitioner payment methods. Maarwell does not process, escrow, guarantee, or refund direct client payments.
Practitioners choose and manage payment links, bank transfer, MB WAY, cash, or other methods. They are responsible for confirmations, receipts/invoices, taxes, refunds and disputes for their services, events, passes and products.
7. Passes, class packs and gifts
A pass or class pack gives you a number of sessions or classes with one practitioner or studio. It becomes usable once the practitioner records payment (or grants it). If the pack has a validity period, it runs from activation; otherwise it does not expire.
A pass request paid by transfer, MB WAY or link that stays unpaid is closed after 14 days, with a warning first. You can cancel your own request, and the practitioner can decline it.
Gifts: a signed-in member can buy a pass or class pack for someone else. The recipient redeems it with the gift code; the validity period starts when it is claimed. You can't gift to yourself. Gift refunds are handled by the practitioner or studio like any pass.
8. Events and group sessions
Events may have capacity, waitlists, prices, refund windows, cancellation policies, and payment instructions. The host is responsible for event descriptions, logistics, safety, delivery, changes, and cancellations.
Waitlist registration does not guarantee a place. Pending payment, attendance, no-show, and refund treatment follow the event policy and mandatory legal rights.
9. Studio shops
Products in a studio shop are sold by the studio, not by Maarwell. You pay the studio directly; the studio is responsible for the product, delivery, invoice, returns and guarantee.
Orders can be collected at the studio or, where offered, delivered within mainland Portugal for the shipping fee shown. An unpaid order is cancelled automatically after 72 hours.
You have the legal guarantee of conformity for goods (3 years) and the right of withdrawal in §11.
10. Invitations and welcome discounts
A practitioner can give clients a personal link. Someone who books with that practitioner for the first time through it may get a welcome discount (up to 50%) on their first paid booking. One welcome discount per person per practitioner.
When a friend you invited completes and pays for a session, you may get a reward from the practitioner (a free session or a discount), usable only with that practitioner. Up to 5 rewards per person in any 12 months.
Discounts and rewards are funded by the practitioner, have no cash value, can't be transferred or combined (we apply the one that saves you most), and are lost if obtained through fake accounts, self-referral or other abuse. A practitioner can change or end their programme for future invitations.
11. Your right of withdrawal
When you buy at a distance from a practitioner or studio, Portuguese law (Decreto-Lei 24/2014) gives you 14 days to withdraw from the contract without giving a reason:
- Bookings for a specific date and time (sessions, classes, events) are leisure services with a fixed date and have no right of withdrawal; the cancellation policy applies instead.
- Passes and class packs without a fixed date: 14 days from purchase. If you ask to use a session within those 14 days, you pay for the sessions used.
- Shop products: 14 days from receiving them. You return them at your cost unless the studio says otherwise, and the studio refunds you within 14 days. Sealed hygiene products opened after delivery can't be returned.
To withdraw, tell the practitioner or studio clearly (a message on Maarwell works). They, not Maarwell, refund you.
12. Practitioner and studio plans
Practitioners may use the Free or Pro plan; studios use the Studio plan. Plans are for business use, so the consumer right of withdrawal does not apply. Paid plans are managed through Stripe Checkout and Stripe's secure billing portal.
New practitioners get 60 days of Pro, and studios 60 days of Studio from approval, free and without a card. Nothing is charged when a trial ends: the account moves to the Free plan unless you choose a paid plan. We email you before it ends.
Prices include Portuguese VAT (IVA) at the statutory rate. After each payment, Stripe emails you a payment receipt; that receipt is not a tax invoice (fatura).
Paid plans renew automatically each month or year until cancelled. You can cancel at any time in the billing portal; the plan stays active until the end of the period already paid, and we don't refund part periods unless the law requires it.
If a Studio plan ends, everything the studio has already published stays live (profile, bookings, check-in, payments and members); weekly classes stop adding new dates, and creating new classes, events and packs depends on the plan.
Ambassador programme: a practitioner who invites another practitioner whose page we approve can earn 3 extra months of Pro (or an equal credit if they pay by card); the new practitioner gets 6 months of Pro trial. Up to 5 in any 12 months.
13. Practitioner responsibilities
If you use Maarwell as a practitioner or studio, you are responsible for truthful profiles, credentials, licences, insurance, scope of practice, client suitability, service delivery, communications, policies, taxes, receipts/invoices, and compliance with applicable law.
- Keep service, pricing, availability, location, event, pass, cancellation, and refund details clear and current.
- Honour the terms shown to clients when they book, or explain changes before accepting a session.
- Get your client's explicit consent before recording information about their health.
- Do not misrepresent credentials, outcomes, professional authorisation, or your relationship with Maarwell.
14. Your content
You keep ownership of what you post: profile text, photos, reviews, messages and files. You give Maarwell a free, non-exclusive, worldwide licence, for as long as the content is on the platform, to host, copy, adapt for display (for example resize), translate automatically and show it on Maarwell and in links that promote your public profile, classes or events.
The licence ends when you delete the content or your account, except for reviews (§17) and copies the law requires us to keep.
Only post content you have the right to post, including photos of other people with their permission. The Maarwell name, design and software are ours: don't copy, scrape or reverse-engineer the platform.
15. Acceptable use
Do not use the platform for unlawful, abusive, deceptive, discriminatory, harassing, spam, privacy-invasive, rights-infringing, or unauthorised-access activity, or to get around limits or security measures.
16. Reporting illegal content and our decisions
Anyone can report a profile, review, message, class, event or booking with the Report button, or by email to the contact below. Say what it is, where it is and why you think it is illegal or breaks these terms, and confirm you are reporting in good faith.
We review reports promptly and impartially, by people (no automated decisions), and tell the person who reported what we decided.
If we remove or restrict content, or suspend or close an account, we tell the person affected the reasons and the rule applied, unless the law or safety prevents it. You can contest the decision within 6 months by replying to that email; someone not involved in the original decision reviews it.
After a warning, we may suspend people who often post clearly illegal content or often send clearly unfounded reports.
17. Trust, verification, and reviews
Verified, Profile reviewed, and similar trust signals mean only that Maarwell reviewed selected identity, profile, credential, or activity materials. Verification is not a guarantee of quality, legality, safety, clinical suitability, outcomes, or lack of risk, and it is not a medical endorsement.
Reviews should reflect real experiences, may be moderated for safety or integrity, and practitioners may reply. If you close your account, your reviews stay, shown as "Former client".
18. How results are ordered
Results are ordered by a quality score: rating (adjusted for how many reviews there are), availability, a complete profile (photo, bio, a bookable service and verification) and how well the profile matches your search. Profiles that accept booking requests come before profiles that don't.
Exact ties are settled by verification, then featured placement, then name. Featured placement is earned through activity on the platform and is never sold. No one can pay for a higher position.
Practitioner reviews come only from people who booked and completed a session. Studio reviews come only from people who registered for a class that has ended.
19. Health, wellness, and emergencies
Maarwell facilitates connections and tools, but does not provide medical, psychological, nutrition, movement, legal, or financial advice. In an emergency, call 112.
Clients decide whether a session, practitioner, event or plan is suitable for them. Practitioners are responsible for their advice, professional scope, and duties to clients.
Practitioners must hold any registration the law requires for the services they offer, for example registration with the Ordem dos Nutricionistas to give clinical nutrition advice.
20. Availability and liability
We work to keep Maarwell available and secure, but we can't promise it will always run without interruption or errors. We may change features, and we tell you in advance about changes that materially affect paid plans.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, wilful misconduct or gross negligence, or for anything else the law does not allow us to limit.
Within those limits: we are not liable for the services, products, events, advice or payments of practitioners and studios, which they provide under their own contract with you, or for loss that was not foreseeable when you accepted these terms. Our total liability to you in any 12 months is limited to the greater of what you paid Maarwell in that period and €100.
As a consumer, you keep all your statutory rights.
21. Closing your account and suspension
You can close your account at any time in Account › Privacy & security. Once we approve the request you have 7 days to change your mind; then your data is erased as described in the Privacy Policy. Open bookings, passes and payments with practitioners stay between you and them.
We may suspend or close an account, with reasons (§16), if you seriously or repeatedly break these terms, act fraudulently, put others at risk, or if the law requires it. Where a breach can be put right, we warn you first. Practitioners and studios have the extra notice periods in the Practitioner Terms.
If we stop running Maarwell, we give at least 30 days' notice so you can export your data.
22. Alternative dispute resolution
For a dispute about a session, class or event, contact the practitioner or studio first: they provide the service and receive the payment.
If you are a consumer and a dispute with us is not resolved, you can turn to an alternative dispute resolution entity: CIAB – Centro de Informação, Mediação e Arbitragem de Consumo (Tribunal Arbitral de Consumo), www.ciab.pt, or CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, www.cniacc.pt. More information at www.consumidor.gov.pt.
You can also file a complaint in the electronic complaints book (Livro de Reclamações; see Contact).
23. Changes to these terms
We may change these terms because of changes in the law, in our services, or for security. We email account holders at least 30 days before a change that affects them takes effect, and publish the new version here with its date. If you don't agree, you can close your account at no cost before then. Changes the law requires, or that fix a security problem, can take effect sooner.
24. Governing law and general terms
Governing law and forum: Portugal, with Portuguese courts as the non-exclusive forum unless mandatory consumer law gives you another right. If you live in another EU country, you keep the protection of that country's mandatory consumer rules.
Nothing in these terms limits mandatory consumer rights that cannot be waived by contract. If one part is invalid, the rest continues to apply to the fullest extent permitted. If we don't enforce a term straight away, we can still enforce it later.
